Video surveillance in schools and kindergartens with parental access is absolutely legal.
According to the conclusion of 3 independent groups of lawyers, the introduction of video surveillance in educational institutions of school and preschool education with regulated access of parents (legal representatives) of students and pupils in the territory of the Russian Federation is fully competent and must meet the requirements of the legislation.
In particular, Article 41 of the Constitution of the Russian Federation states that everyone has the right to health protection. And according to paragraphs. 8 p. 1 of Art. 41 of the Law on Education, health protection of students includes ensuring their safety during their stay in an educational organization. Also pp. 2 p. 6 art. 28 of the same law states that an educational organization is obliged to create safe conditions for the education and upbringing of students.
An educational organization has autonomy, which means independence in the implementation of educational, scientific, administrative, financial and economic activities, the development and adoption of local regulations, and the parents (legal representatives) of minor students have the right to get acquainted with the content of education, the methods of teaching and upbringing used, educational technologies, as well as with assessments of the progress of their children, to protect the rights and legitimate interests of students.
In addition, paragraph 13 of Art. 30 of the Federal Law of 30.12.2009 N 384-FZ "Technical Regulations on the Safety of Buildings and Structures" it is prescribed that television surveillance systems must be installed in the buildings of educational institutions.
The obligation to install a video surveillance system in educational institutions is also provided for in clause 5.39 of SNiP 31-06-2009 "Public buildings and structures"
